The Property Standards Bylaw and Yards Bylaw set out the minimum standards for building and property maintenance within the city. The standards described in these bylaws are intended to outline the reasonable maintenance and upkeep of yards, buildings and properties. They are not intended to reflect those set out in newly constructed buildings. However, the City does recognize the importance of maintaining existing buildings.

Some examples of standards covered by the property standards bylaw include:

  • Heating and Heating Systems
  • Electrical and Plumbing services
  • Pest Prevention
  • Graffiti
  • Yards, lands, vacant land and buildings

Evictions

Your landlord can only evict you in specific situations. Rules for evictions are set by the Government of Ontario.

  • Your landlord must give written notice using the proper form from the Landlord and Tenant Board (LTB). The reason for eviction must be stated.
  • Before you are required to move out, your landlord must also apply for and receive an eviction order from the LTB. You have the right to go to a hearing and explain why you should not be evicted. 
  • Under the Protecting Tenants and Strengthening Community Housing Act, 2020, landlords are encouraged to try to negotiate a repayment agreement with a tenant before seeking eviction.

Filing a Tenant Rights Application

Under certain circumstances, a tenant or former tenant may file an Application About Tenant Rights (T2) with the LTB. Circumstances include if the landlord, superintended or agent of the landlord:

  • illegally entered the unit,
  • withheld the reasonable supply of any vital service, care service or food that it is the landlord’s obligation to supply under the tenancy agreement or deliberately interfered with the reasonable supply of any vital service, care service or food, or
  • harassed, obstructed, coerced, threatened or interfered with a tenant.

Property Deficiencies

Residents who are renting and are experiencing a problem should inform the landlord/superintendent and/or property owner of any deficiencies, maintenance and repair issues. Written correspondence is preferred, notification by phone is acceptable. Keep a copy of all correspondence for your records.

You must provide a reasonable timeframe for the deficiencies to be resolved. If they are not addressed, you can contact Property Standards at bylawenforcement@cityofkingston.ca or 613-546-0000.
